1. Introduction
1.1 Agreement Overview
These Terms and Conditions (the "Terms") constitute a legally binding agreement between Kipgo Pvt. Ltd, a company incorporated under the laws of Pakistan ("Kipgo", "we", "us", or "our"), and you, the individual accessing or using our platform to browse, book, or otherwise engage with travel-related services ("Customer", "you", or "your").
By accessing or using the Kipgo platform, creating an account, making a booking, or otherwise interacting with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use our platform.
1.2 About Our Platform
Kipgo operates an online travel marketplace that connects travelers with local tourism service providers ("Suppliers") across Pakistan. Our platform enables you to discover, compare, and book a wide range of travel experiences including tours, treks, activities, experiences, accommodations, car rentals, and bike rentals.
It is important to understand that Kipgo is a technology platform that facilitates connections between you and Suppliers. We are not a travel agency, tour operator, accommodation provider, or transportation company. When you make a booking through our platform, you enter into a direct contractual relationship with the Supplier who will provide the service. Kipgo acts as a commercial agent on behalf of Suppliers to facilitate the booking process and collect payments.
1.3 Incorporated Documents
These Terms incorporate by reference our Privacy Policy, Cancellation and Refunds Policy, and Dispute Resolution Policy. Together, these documents form the complete agreement between you and Kipgo regarding your use of the platform. You are responsible for reviewing and understanding all incorporated documents, which are available on our website.
In the event of any conflict between these Terms and any incorporated document, these Terms shall prevail unless the incorporated document explicitly states otherwise.
2. Definitions
Throughout these Terms, the following words and phrases have specific meanings that are important for understanding your rights and obligations:
"Platform" refers to all digital properties operated by Kipgo, including our website (gokipgo.com), mobile applications, and any related tools, features, or services that enable you to browse listings, make bookings, communicate with Suppliers, or manage your account.
"Supplier" means any individual, company, or a business entity that has registered with Kipgo to offer travel-related services through the Platform.
"Listing" means any service offering published by a Supplier on the Platform, including the description, photographs, pricing, availability, inclusions, exclusions, and any other information provided about the service.
"Booking" means a confirmed reservation for a Listing made by you through the Platform, evidenced by a booking confirmation number and confirmation email.
"Listing Snapshot" means the complete record of a Listing's details as they existed at the exact moment you completed your Booking. This snapshot preserves the terms, pricing, inclusions, and policies that apply to your specific Booking, even if the Supplier later modifies the Listing.
"Service Agreement" means the direct contractual relationship formed between you and the Supplier when you complete a Booking. Kipgo is not a party to this agreement.
"Add-ons" means optional extras or enhancements that you may select in addition to the base Listing, such as additional equipment, meals, transportation, or supplementary services.
3. Our Role
3.1 Commercial Agent
When you make a Booking, Kipgo acts as a commercial agent on behalf of the Supplier. This means we are authorised by the Supplier to accept your booking request, process your payment, issue booking confirmations, and handle certain communications on their behalf. Payment made to Kipgo for a Booking is considered payment made to the Supplier.
3.2 What We Do Not Do
Kipgo does not own, operate, manage, or control the services offered by Suppliers. We do not employ the guides, drivers, or staff who deliver services. We do not own or operate the vehicles, accommodations, or equipment used in service delivery. We do not set the prices, availability, or terms of individual Listings, as these are determined by each Supplier.
While we take steps to verify Suppliers and review Listings before they appear on the Platform, we cannot guarantee the accuracy of information provided by Suppliers, the quality of services delivered, the conduct of Supplier personnel, or the safety of any activity or experience. The Supplier bears full responsibility for the services they provide.
4. Your Account
4.1 Account Creation
While you may browse Listings without an account, creating an account is required to make Bookings, save favourites, message Suppliers, and access your booking history. You may create an account by registering with your email address and creating a password, or by using your Google account through our social login feature.
When creating an account, you must provide accurate and complete information. You agree to keep your account information current and to update it promptly if any changes occur.
4.2 Account Deletion
You may delete your account at any time from the Account section in your profile settings, provided you have no confirmed Bookings. Upon deletion, your name and email are permanently removed from our systems. However, records related to your account activity — including booking history, messages, and reviews — are preserved for operational and legal purposes.
5. Browsing and Listings
5.1 Listing Information
All Listings on the Platform are created and maintained by Suppliers. The information in each Listing, including descriptions, photographs, itineraries, inclusions, exclusions, pricing, and policies, is provided by the Supplier and represents their offering. While Kipgo reviews Listings before they are published to ensure they meet our content guidelines, we do not independently verify every detail provided by Suppliers.
You should carefully review all Listing details before making a Booking. If you have questions about a Listing that are not addressed in the description, you may use the public Questions & Answers section on the Listing page to ask the Supplier directly.
5.2 Pricing Display
All prices on the Platform are set by Suppliers and displayed in Pakistani Rupees (PKR) as the base currency. For your convenience, we may display prices converted to other currencies based on your location or preferences. These conversions are approximate and provided for reference only. The actual amount charged will be calculated at the time of checkout based on the prevailing exchange rate if you are paying in a currency other than PKR.
Displayed prices include all mandatory fees and charges. If a Listing has optional Add-ons, the base price shown is for the core offering without Add-ons. The total price including any selected Add-ons will be clearly displayed before you confirm your Booking.
5.3 Questions & Answers
Each Listing has a public Questions & Answers section where you can ask the Supplier questions before booking. Questions and answers are visible to all users to help future travelers make informed decisions. You should use this feature for questions about the experience, requirements, or logistics that are not addressed in the Listing description.
5.4 Group Tours and Minimum Participants
Some group tours and treks require a minimum number of participants to operate. Where applicable, this information is disclosed in the Listing's "What to Know" section. If a tour does not meet the minimum participant requirement, the Supplier may cancel or reschedule the departure. In such cases, you will be offered a full refund or the option to rebook for a different date.
5.5 Availability
Availability shown on the Platform is provided in real-time by Suppliers and is subject to change. A Listing may show availability at the time you begin the booking process but become unavailable before you complete payment. In such cases, you will be notified that the booking cannot be completed, and no payment will be processed.
6. Making a Booking
6.1 Booking Process
To make a Booking, you select a Listing, choose your preferred date and any applicable options such as the number of participants or Add-ons, and proceed to checkout. During checkout, you will be asked to provide traveler details, review the total price including any applicable fees, and complete payment. Once payment is successfully processed, your Booking is confirmed and you will receive a confirmation email containing your booking details and a downloadable booking confirmation.
6.2 Listing Snapshot
At the moment you complete your Booking, we capture a Listing Snapshot that records the exact terms, pricing, inclusions, exclusions, and policies of the Listing as they existed at that time. This Listing Snapshot becomes part of your Service Agreement with the Supplier and represents what you are entitled to receive, regardless of any subsequent changes the Supplier may make to the Listing.
If a dispute arises about what was included in your Booking, the Listing Snapshot will serve as the definitive reference for resolving that dispute.
6.3 Booking Confirmation
Your Booking is confirmed only when you receive a confirmation email from Kipgo containing a unique booking confirmation number. This email includes a PDF attachment with your complete booking details, which serves as your receipt and proof of booking. You should retain this PDF and may be required to present it to the Supplier when you arrive for your experience.
6.4 Booking on Behalf of Others
If you make a Booking on behalf of other travelers, you represent and warrant that you have the authority to accept these Terms on their behalf and that all information provided for those travelers is accurate. You are responsible for ensuring that all travelers in your Booking are aware of and comply with any applicable terms, requirements, or restrictions.
6.5 Traveler Information
You must provide accurate traveler information as requested during the booking process. This may include full legal names, ages, contact details, emergency contacts, and any other information required by the Supplier or by law. Inaccurate information may result in denial of service, and Kipgo and the Supplier will not be responsible for any consequences arising from information you provided incorrectly.
7. Pricing and Payments
7.1 Currency and Pricing
All Listings are priced in Pakistani Rupees (PKR). Customers in Pakistan pay in PKR. International customers pay in US Dollars (USD), with the amount calculated based on the PKR equivalent at the time of checkout.
7.2 Payment Methods
We accept various payment methods to accommodate both local and international customers. International credit and debit card payments are processed securely through Checkout.com. For customers in Pakistan, we offer local payment options including bank transfers and local card payments.
All payment transactions are processed through secure, encrypted connections. Kipgo does not store your complete credit card details on our servers. Payment information is handled directly by our payment processors in accordance with applicable security standards.
7.3 When Payment is Charged
Payment is charged at the time you complete your Booking. The full amount of the Booking, including any selected Add-ons and applicable fees, will be charged to your selected payment method when you click the button to confirm and pay.
7.4 Coupons and Discounts
From time to time, Kipgo or Suppliers may offer promotional coupons or discount codes. Coupons are subject to specific terms and conditions, including validity periods, minimum booking values, and restrictions on which Listings they may be applied to. Only one coupon may be used per Booking unless otherwise specified.
Coupons have no cash value and cannot be exchanged for money. If a Booking to which a coupon was applied is cancelled and refunded, the coupon will not be reinstated unless explicitly stated in the coupon terms or at Kipgo's discretion.
8. Cancellations and Refunds
8.1 Cancellation Policy Overview
Each Listing has a cancellation policy that determines whether and how much you may be refunded if you cancel your Booking. The applicable cancellation policy is clearly displayed on the Listing page and on the checkout page before you complete your Booking. It is your responsibility to review and understand the cancellation policy before completing a Booking.
8.2 How to Cancel
You may cancel a Booking through your account on the Platform by navigating to your Bookings and selecting the cancellation option. If you cancel within the free cancellation deadline, your Booking is cancelled immediately and your refund is usually processed within 24 hours. You may also contact our support team at support@gokipgo.com for assistance.
8.3 Cancellation After Deadline
You may also request cancellation after the free cancellation deadline has passed. In such cases, a partial or full refund may be processed at Kipgo's discretion, depending on the circumstances and timing of your request.
8.4 Unexpected Events
We understand that serious unexpected events — such as medical emergencies, family emergencies, or other unforeseen circumstances — can disrupt travel plans. If you experience a genuine emergency that prevents you from using your Booking, please contact our support team. Refunds beyond the standard cancellation deadline may be considered on a case-by-case basis, and we may request documentation to support your request.
8.5 Refund Processing
If you are entitled to a refund, we will process it to your original payment method. Refunds typically take five to ten business days to appear in your account, though the exact timing depends on your payment provider.
8.6 Supplier Cancellations
In rare cases, a Supplier may need to cancel a confirmed Booking due to circumstances beyond their control, such as severe weather, safety concerns, or insufficient participants for a group tour. If a Supplier cancels your Booking, you will be notified as soon as possible and will receive a full refund of the amount paid.
8.7 Force Majeure
Neither Kipgo nor Suppliers shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, acts of terrorism, war, civil unrest, government actions, pandemics, or severe weather conditions. In such circumstances, we will work with you and the Supplier to find a reasonable solution, which may include rebooking for a future date or providing a refund or credit.
8.8 Detailed Policy
For complete details about cancellation deadlines, refund calculations, and special circumstances, please refer to our separate Cancellation and Refunds Policy, which is incorporated into these Terms by reference.
9. Your Responsibilities
9.1 Accurate Information
You are responsible for providing accurate and complete information when creating an account, making a Booking, or communicating with Suppliers. This includes traveler names, contact details, ages, and any health or accessibility information that may be relevant to your participation in an activity.
9.2 Compliance with Supplier Policies
When you book a service, you agree to comply with the Supplier's terms, rules, and instructions. This includes following safety guidelines, arriving on time, meeting any eligibility requirements (such as fitness levels or age restrictions), bringing required documents or equipment, and adhering to any code of conduct specified by the Supplier.
If you fail to comply with Supplier requirements and are denied service as a result, you will not be entitled to a refund.
9.3 Respectful Conduct
You agree to treat Supplier staff, guides, and other travelers with respect and courtesy. Abusive, threatening, discriminatory, or otherwise inappropriate behaviour is prohibited and may result in immediate termination of the service without refund, removal from the Platform, and potential legal action.
9.4 Prohibited Activities
You must not use the Platform for any unlawful purpose or in any way that could harm Kipgo, Suppliers, or other users. Prohibited activities include making fraudulent bookings or payments, using stolen payment credentials, creating fake accounts or reviews, attempting to circumvent the Platform to book directly with Suppliers you discovered through Kipgo, scraping or copying content from the Platform, interfering with the Platform's operation or security, and harassing or abusing Suppliers or their staff.
9.5 Travel Documents and Requirements
You are solely responsible for ensuring you have all necessary travel documents, including valid identification, visas, permits, and any health or vaccination certificates required for your travel. Certain services — particularly those involving restricted areas or government permissions — may require you to provide your passport or other identification documents to the Supplier for processing Letters of Invitation (LOI) or other permits. By booking such services, you agree to provide the required documentation to the Supplier in a timely manner. Kipgo does not provide advice on travel documentation and will not be liable if you are unable to participate in a booked service due to missing or inadequate documentation.
9.6 Travel Insurance
Kipgo strongly recommends that you obtain comprehensive travel insurance before embarking on any trip booked through the Platform. Travel insurance can provide coverage for trip cancellation, medical emergencies, evacuation, lost baggage, and other unforeseen circumstances. Neither Kipgo nor Suppliers provide travel insurance, and we are not liable for losses that could have been covered by appropriate insurance.
9.7 Personal Belongings
You are responsible for safeguarding your personal belongings during any booked experience. Neither Kipgo nor Suppliers are liable for loss, theft, or damage to your personal property, including luggage, electronics, documents, or valuables, unless such loss results directly from the Supplier's gross negligence.
10. Service Delivery
10.1 What to Expect
When you arrive for your booked experience, the Supplier is obligated to deliver the service as described in the Listing Snapshot captured at the time of your Booking. This includes the itinerary, inclusions, duration, and any other details specified. You should refer to your booking confirmation PDF for the complete details of what was promised.
10.2 Minor Modifications
Travel experiences are inherently dynamic, and minor modifications to itineraries or logistics may occasionally be necessary due to weather conditions, road closures, local regulations, or operational requirements. Suppliers may make reasonable adjustments that do not materially alter the nature or value of the experience. Such minor modifications do not entitle you to a refund.
10.3 Weather and External Factors
Many experiences offered on the Platform are subject to weather conditions and other external factors beyond anyone's control. Suppliers may modify, reschedule, or cancel activities due to unsafe weather conditions, natural events, government orders, or other circumstances affecting safety or feasibility. In such cases, the Supplier will work with you to find an alternative arrangement, which may include rescheduling, offering an alternative experience, or providing a refund in accordance with the cancellation policy.
10.4 Service Issues
If the service you receive differs materially from what was described in the Listing Snapshot, or if you experience any issues during your experience, you should first attempt to resolve the matter directly with the Supplier on-site. If the issue cannot be resolved, document the problem (with photographs or written notes) and contact Kipgo support within 4 days of the service date to file a dispute.
11. Assumption of Risk
11.1 Inherent Risks of Travel
Travel and adventure activities involve inherent risks that cannot be entirely eliminated. These risks include, but are not limited to: physical injury or illness, exposure to extreme weather or altitude, accidents involving vehicles, watercraft, or animals, natural hazards such as landslides, avalanches, or flooding, and risks associated with remote locations with limited medical facilities.
11.2 Your Assessment
You are responsible for assessing whether an activity is appropriate for you based on your health, physical fitness, experience level, and risk tolerance. Many Listings include fitness requirements, age restrictions, or health advisories — you must honestly evaluate your ability to meet these requirements before booking.
11.3 Acceptance of Risk
By booking and participating in any experience through the Platform, you acknowledge that you understand the inherent risks involved, voluntarily assume those risks, and agree that neither Kipgo nor the Supplier shall be liable for injuries, losses, or damages arising from inherent risks, except where caused by gross negligence or willful misconduct.
12. Reviews
12.1 Leaving Reviews
After completing a booked experience, you may be invited to leave a review sharing your feedback about the service. Reviews help other travelers make informed decisions and help Suppliers understand how to improve their offerings. We encourage you to leave honest, detailed reviews of your experiences.
12.2 Review Guidelines
Reviews must be based on your genuine personal experience with the booked service. Reviews must not contain false or misleading statements, personal attacks or discriminatory language, content that violates the privacy of others, promotional content or spam, or content that is obscene, illegal, or otherwise objectionable.
You must not accept payment or other incentives in exchange for leaving a positive review, and you must not leave fake reviews for services you did not actually use.
12.3 Review Moderation
Kipgo reserves the right to moderate, edit, or remove reviews that violate our guidelines or these Terms. We may also remove reviews that appear to be fraudulent or that are the subject of a dispute where evidence suggests the review is inaccurate. Suppliers may respond to reviews publicly, but may not pressure or incentivize you to change or remove a review.
13. Messaging
13.1 Purpose of Messaging
The Platform includes a messaging system that allows you to communicate privately with Suppliers regarding your Bookings. This feature is provided to facilitate booking-related communication, coordinate logistics, and address any questions or concerns about your upcoming experience.
13.2 Privacy of Messages
Messages exchanged through the Platform are private and can only be seen by you, the Supplier, and Kipgo. We do not share your message content with other users or third parties, except as required by law or as necessary to resolve disputes or investigate violations of these Terms.
13.3 Response Times
Suppliers are expected to respond to messages in a timely manner. If a Supplier does not respond to your messages within a reasonable timeframe (typically 24-48 hours), you may contact Kipgo support for assistance.
13.4 Restrictions
You must not use the messaging system to share personal contact information with the intent of booking outside the Platform and avoiding Kipgo's fees. You must not use messaging to send spam, promotional content, or any content that violates these Terms. Attempts to circumvent the Platform may result in account suspension.
13.5 Message Retention
Messages sent through the Platform are retained in our systems and may be accessed by Kipgo for purposes including customer support, dispute resolution, safety investigations, and quality assurance.
14. Intellectual Property
14.1 Kipgo Content
The Platform and its original content, features, and functionality are owned by Kipgo and are protected by copyright, trademark, and other intellectual property laws. This includes our logo, brand elements, website design, software code, and any text, graphics, or other materials created by Kipgo.
14.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial purposes. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Platform or its content, or to reverse engineer or attempt to extract the source code of any software.
14.3 Supplier Content
Listing content including photographs, descriptions, and other materials provided by Suppliers remains the property of the respective Suppliers or their licensors. You may not use Supplier content for any commercial purpose without the Supplier's express permission.
14.4 Your Content
By submitting reviews or questions to the Platform, you grant Kipgo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with operating and promoting the Platform. You retain ownership of your content but acknowledge that we may use it as described. This license does not apply to private messages, which remain confidential as described in Section 13.
15. Data Protection
Any unauthorised use of automated tools, scripts, bots, or other methods to extract, scrape, harvest, or collect data from the Platform — including but not limited to Listings, reviews, pricing information, Supplier details, or any other publicly available content — is strictly prohibited. Violation of this provision may result in immediate account termination, legal action, and claims for damages.
16. Disclaimers
16.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's operation, availability, or suitability for any particular purpose. We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
16.2 Supplier Services
Kipgo does not guarantee the quality, safety, legality, or suitability of any services offered by Suppliers. While we take steps to verify Suppliers and review Listings, we cannot warrant that Listings are accurate or complete, that Suppliers will perform as described, that services will meet your expectations, or that activities are safe for all participants.
You acknowledge that travel and adventure activities involve inherent risks, including the risk of injury or death. You participate in any booked activity at your own risk and are responsible for assessing whether an activity is appropriate for you based on your health, fitness, experience, and risk tolerance.
16.3 Third-Party Content and Links
The Platform may contain links to third-party websites or display content from third parties. We do not control, endorse, or assume responsibility for any third-party content or websites. Your interactions with third parties, including Suppliers, are solely between you and them.
17. Limitation of Liability
17.1 Exclusion of Certain Damages
To the maximum extent permitted by applicable law, Kipgo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of or inability to use the Platform, any conduct or content of any third party on the Platform, any content obtained from the Platform, or unauthorised access, use, or alteration of your content or information.
17.2 Liability Cap
In no event shall Kipgo's total liability to you for all claims arising from or related to these Terms or your use of the Platform exceed the amount you paid to Kipgo for the Booking giving rise to the liability.
17.3 Basis of the Bargain
You acknowledge that Kipgo has set its fees and entered into these Terms in reliance upon the limitations of liability set forth herein, and that these limitations form an essential basis of the bargain between you and Kipgo.
18. Disputes and Complaints
18.1 Reporting Issues
If you experience any issues with a booked service, we encourage you to first attempt to resolve the matter directly with the Supplier during or immediately after the service. If you are unable to resolve the issue with the Supplier, you may file a dispute through Kipgo by contacting our support team at support@gokipgo.com or by submitting a support ticket through your account.
18.2 Kipgo's Role in Disputes
Kipgo acts as a neutral intermediary in disputes between Customers and Suppliers. We will review the information provided by both parties and the Listing Snapshot, and may make a determination regarding refunds or other remedies. While we strive to be fair and reasonable, our decisions are final and binding.
Please note that because the Service Agreement is between you and the Supplier, certain disputes may need to be resolved directly with the Supplier or through appropriate legal channels.
18.3 Time Limits for Disputes
To ensure disputes can be properly investigated, you must report issues within specific timeframes. Service quality disputes must be filed within four (4) days after service completion. No-show or non-delivery disputes must be filed within four (4) days of the scheduled service date. Safety or misconduct disputes must be filed within thirty (30) days after service completion. Disputes filed outside these timeframes may not be accepted.
18.4 Chargebacks
If you initiate a chargeback through your bank or payment provider instead of working with Kipgo to resolve an issue, we reserve the right to suspend your account pending investigation. Unjustified chargebacks may result in permanent account termination. We encourage you to contact us first to resolve any payment disputes.
18.5 Detailed Policy
For complete details about the dispute resolution process, including how disputes are investigated and decided, please refer to our separate Dispute Resolution Policy, which is incorporated into these Terms by reference.
19. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and share your personal information when you use the Platform. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.
In summary, we collect information you provide directly to us (such as account details and booking information), information collected automatically (such as usage data and device information), and information from third parties (such as social login providers). We use this information to operate the Platform, process your Bookings, communicate with you, improve our services, and for other purposes described in the Privacy Policy.
When you make a Booking, certain information is shared with the relevant Supplier so they can provide the service. Please review our Privacy Policy for complete details about our data practices.
20. Changes to Terms
20.1 Right to Modify
Kipgo reserves the right to modify these Terms at any time at our sole discretion. We may make changes to reflect updates to the law, changes to our services, or for other operational or legal reasons.
20.2 Notification of Changes
If we make material changes to these Terms, we will notify you by email (if you have an account) or by posting a prominent notice on the Platform. The updated Terms will indicate the effective date at the top of the document.
20.3 Acceptance of Changes
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform. Changes to these Terms will not apply retroactively to Bookings made before the changes took effect.
21. General Provisions
21.1 Governing Law
These Terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles.
21.2 Jurisdiction
Any legal action or proceeding arising from or related to these Terms shall be brought exclusively in the courts of competent jurisdiction in Pakistan. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
21.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
21.4 Entire Agreement
These Terms, together with the incorporated documents (Privacy Policy, Cancellation and Refunds Policy, and Dispute Resolution Policy), constitute the entire agreement between you and Kipgo regarding your use of the Platform and supersede any prior agreements or understandings.
21.5 No Waiver
